Terms of Service

1. Acceptance of terms

By accessing macherp.in or using the Mach ERP platform, you agree to these Terms of Service. If you are accepting on behalf of an organisation, you represent that you have authority to bind that organisation.

2. The service

ATTAINMACH33 LLP provides Mach ERP — a cloud-hosted ERP platform — on a subscription basis. We provide a dedicated instance per client hosted on AWS Mumbai. The service includes implementation, data migration, and ongoing support as described in your agreement.

3. Your data

You retain ownership of all data you enter into the Mach ERP platform. We process your data only to provide the service. On termination, we will provide a full data export within 48 hours of your request. Data is deleted from our systems 90 days after the export is provided.

4. Acceptable use

You agree not to:

  • Use the platform for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the platform
  • Resell or sublicense access to the platform without written permission
  • Upload data that infringes third-party intellectual property rights

5. Availability and uptime

We aim for 99.5% uptime. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by factors outside our control (force majeure, AWS outages, etc.).

6. Payment

Subscription fees are due as per the terms in your signed agreement. GST is charged as applicable. Late payment may result in service suspension after 15 days of non-payment.

7. Limitation of liability

To the fullest extent permitted by law, ATTAINMACH33 LLP's liability for any claim arising from use of the platform is limited to the fees paid in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

8. Governing law

These terms are governed by the laws of India. Any disputes are subject to the jurisdiction of courts in New Delhi.

9. Changes to these terms

We may update these terms from time to time. We will notify active clients of material changes. Continued use of the platform constitutes acceptance of the updated terms.
